Terms and Conditions

These Terms & Conditions (the “Terms”) apply to every visit to eclipsesail.com (the “Site”) and to every booking of an Eclipse LLC (“Eclipse,” “we,” “our,” or “us”) sailing experience or charter made through the Site, by phone, or in person. By accessing the Site or completing a booking, you (“Guest,” “Client,” or “Skipper”) agree to be bound by:

these Terms;

our Privacy Policy; and
-
the applicable Liability Waiver that must be signed before boarding.
1. Eligibility & Acceptance

Minimum guest age is 10 years.

Guests aged 10–13 must sail with one dedicated supervising adult plus one additional adult.

For bareboat charters (when available):
-
The Skipper must hold a District of Columbia Safe‑Boating Certificate.

Skipper must be 18 years or older.
-

By completing checkout, submitting payment, or clicking “I Agree”, you acknowledge that you have read and accepted these Terms and the relevant Waiver, which together form a binding contract.
2. Services & Prices

Instructor‑Guided Sailing Experience – $130 per seat + 6 % DC sales tax for a 2.5‑hour session (includes onboarding/off‑boarding).

Multi‑sail packs, gift cards, and promotional rates are displayed at checkout and are subject to availability.

Eclipse may modify prices at any time before you place a booking. Once payment clears and a confirmation email is issued, your price is locked in.
3. Payment & Security

Full payment is due at booking via Wix Payments.
Cards are processed over TLS‑encrypted connections; Eclipse never stores full card numbers. -
The payer must be an authorized user of the payment method.
4. Cancellations, Rescheduling & Refunds

Client or Skipper Initiated
-
48 hours or more before departure: Full refund to the original payment method.
-
Less than 48 hours before departure or no‑show: No refund (re‑credit at Eclipse’s sole discretion for charters).

Eclipse Initiated (weather, safety, or force‑majeure)
-
Any time: Choice of a full refund or a complimentary reschedule within 6 months.

Late arrival after the scheduled departure time is treated as a no‑show.
5. Safety Rules & Guest Conduct

Life Jackets – All persons must wear a properly fastened USCG‑approved life jacket at all times while aboard.

Captain’s Orders – Guests must follow all lawful instructions of the Instructor/Captain. Disruptive or impaired parties may be returned to the dock without refund.

Prohibited Items – No alcohol, smoking, vaping, glass containers, or pets are permitted on board.
-
Attire – Appropriate, non‑marking footwear is required; dress for sun, wind, and spray.

Weather Authority – Eclipse may cancel, shorten, or postpone any outing if:
-
sustained wind ≥ 20 kt,
-
heat‑index > 103 °F,
-
AQI ≥ 150,
-
lightning with thunder ≤ 30 s,
-
visibility < 1 NM, or
-
other unsafe conditions arise.

6. Damage, Loss & Insurance

Guests must exercise reasonable care of the vessel and equipment.

Damage caused by negligence or misconduct will be charged to the booking card up to:
-
the repair or replacement cost plus any lost‑charter downtime.

Eclipse maintains hull and liability insurance, but deductibles and consequential loss of use may be charged where applicable.
7. Liability Waiver & Assumption of Risk

Participation in sailing involves inherent risks, including serious injury or death.
-
All participants must sign the applicable Liability Waiver before boarding.
In the event of conflict, the Waiver governs risk allocation.
8. Photography & Media

Eclipse may capture photos or video during sessions for safety monitoring and marketing.

Guests may opt out by emailing privacy@eclipsesail.com at least 24 hours before departure.
9. Intellectual Property & Website Use

All content on the Site—including text, graphics, logos, and photos—is owned by Eclipse or its licensors.
You may not reproduce or distribute it without written permission. -
Use of generative AI (OpenAI) in our customer‑service chat is for drafting responses; human staff approve all outbound messages.
10. Privacy

Our collection and use of personal information is described in the Privacy Policy.

By using the Site or booking a session, you consent to that policy.
11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the District of Columbia.

Any dispute shall be brought exclusively in the state or federal courts located in Washington, DC; the parties consent to personal jurisdiction therein.
12. Changes to These Terms

Eclipse may update these Terms from time to time. Changes become effective when posted on the Site and apply to bookings made afterward.

The “Effective Date” above will reflect the latest revision.
